Senator Ted Cruz (R-Texas) has introduced a bill aimed at cracking down on illegal immigrants who flee from law enforcement. The proposed legislation, named the Agent Raul Gonzalez Officer Safety Act, honors a Border Patrol agent who died in the line of duty while pursuing illegal migrants in Texas.
The bill seeks to make it a felony to refuse to yield to a Border Patrol agent, with severe legal consequences for offenders.
Honoring Agent Raul Gonzalez
The bill is named after Border Patrol Agent Raul Gonzalez, who was killed in a vehicle crash in 2022 while chasing illegal immigrants. Cruz emphasized that this legislation serves as a tribute to Gonzalez’s sacrifice and aims to enhance the safety of Border Patrol agents.
“This legislation honors the sacrifice of Agent Raul Gonzalez, Jr., who lost his life pursuing individuals evading capture,” Cruz told Fox News Digital.
Key Provisions of the Bill
If passed, the bill would introduce strict penalties for illegal immigrants who flee law enforcement:
- Failure to yield to a Border Patrol agent would be classified as a felony, punishable by up to two years in prison.
- If a Border Patrol agent is injured during the pursuit, the offender could face 5 to 20 years in prison.
- If an agent is killed in the pursuit, the minimum sentence would be 10 years, with the potential for a life sentence.
- In addition to jail time, violators could also face fines of up to $250,000.
The bill also requires the Department of Justice (DOJ) to report to Congress on how frequently illegal immigrants are prosecuted for endangering Border Patrol agents.
House Support and Political Climate
The bill has been reintroduced in the House by Rep. Juan Ciscomani (R-Ariz.), indicating strong Republican support.
The move comes as Congress, now under GOP control, pushes for tougher immigration laws. The shift in political leadership has led to a renewed focus on border security and law enforcement protections.
In January 2025, Congress passed the Laken Riley Act, which mandates federal detention for illegal immigrants accused of theft-related crimes. Former President Donald Trump is expected to sign the bill into law later this month.
